HR 3171

Synopsis:

The Benjamin Franklin True Patriot Act (HR 3171) includes provisions to eliminate the Patriot Act's subjective search-and-seizure provision, unwarranted incarcerations, and the authority of federal officials to search our private records without probable cause. The act would restore the fundamental right of attorney-client privilege and revokes various Department of Justice secrecy orders and repeals provisions harmful to the rights of immigrants. In particular, HR 3171 would:
  • Repeal sneak and peak searches.
  • Repeal searches of library, medical, and financial records without judicial warrant.
  • Repeal detention and deportation of non-citizens without careful judicial review.
  • Cement the fundamental right of attorney-client privilege.
  • Restore transparency to Department of Justice and Department of Homeland Security administrative procedures by revoking FOIA secrecy orders, along with other important provisions.

Current Status:

  • HR 3171 has been referred to committee. In other words, it will not come up for vote (and thus have a chance of being enacted into law) unless it gets out of the committee process.


  • The Speaker of the House (Dennis Hastert) has a significant say on whether or not this bill will be allowed to come to a vote. Additionally, HR 3171 is currently in the following committees:
