Scott McDonald warns us about a new attempt by the U.S. Senate to more directly force states to collect Social Security numbers (SSNs) on state license applications, found in H.R. 3130, Section 403. The bill is currently in a House-Senate conference committee. McDonald's broader privacy and SSN concerns are the subject of this month's Government Technology magazine. In January, he and his sons brought suit against the Alabama Department of Public Safety for refusing to issue driver permits or licenses to residents who do not have SSNs. McDonald and his attorney, Larry Becraft, believe current law regarding use of SSNs is often interpreted too broadly. When contacted by phone, he pointed out that: 1) Broader interpretations have not proved themselves through the court system. 2) Attempts to force states to collect SSNs on state license applications violate principles of the Supreme Court ruling Printz v. United States and are clearly unconstitutional. In this alert he urges everyone to call H.R. 3130 Conference Committee members to oppose provisions which would directly force states to collect SSNs on applications for professional, occupational, driver and recreation licenses, as well as birth certificates, marriage certificates, divorce decrees and death certificates.
