Child Online Protection Act (CDA 2)

Brief Summary of CDA 2 Decision

Nov. 19, 1998 - A federal judge today granted a temporary restraining order against enforcing the provisions of the Child Online Protection Act. Plaintiffs representing Salon Magazine and A Different Light Bookstores sought the order against the Justice Department with the help of the ACLU, EPIC and EFF. The plaintiffs were concerned that their Web publications were vulnerable to censorship under the new law, which allows the federal government to prosecute companies for Internet publications that it might define as "harmful to minors" but that are not obscene and would not be crimes in older paper media.
